Regulations

At Alair Ag Drones, LLC, we are committed to operating in full compliance with all applicable federal and state regulations. Below are the key laws and rules we follow to ensure safe, legal, and professional drone application services in Idaho, Oregon, and beyond. This page is referenced in our service contracts for transparency and client awareness.

Federal Regulations (FAA)
FAA Part 107 Small UAS Rule: We operate under the FAA’s Part 107 regulations for commercial drone operations, requiring:
A valid Remote Pilot Certificate held by our operators.
Maximum altitude of 400 feet above ground level (AGL), unless within 400 feet of a structure.
Daytime operations only, unless equipped with anti-collision lighting for night flights.
Maintaining visual line of sight (VLOS) and yielding to manned aircraft.
Compliance with Remote ID requirements for drones, effective per FAA rules.
Airspace Authorizations: We obtain necessary authorizations via LAANC for operations in controlled airspace (e.g., near airports) when applicable.
Idaho-Specific Regulations
Idaho Code 36-1101: We do not use drones to hunt, locate, or harass game animals, ensuring our services are strictly for agricultural purposes.
Idaho Code 21-213: We do not photograph or record individuals without written consent where privacy is reasonably expected, unless incidental to agricultural tasks.
Idaho Fish and Game Lands (IDAPA 13.01.03): Operations on Fish and Game lands require prior permit approval, which we secure if applicable.
Oregon-Specific Regulations
ORS 837.310-345: We do not fly over private property in a manner that intentionally, knowingly, or recklessly harasses or annoys the owner/occupant after receiving notice to desist.
ORS 837.360: If operating as a public body (unlikely as a private LLC), drones must be registered with the Oregon Department of Aviation (ODA); this does not apply to our operations.
ORS 837.300: We do not weaponize drones or use them to interfere with public safety operations (e.g., firefighting).
General Compliance
Pesticide Regulations: We comply with state pesticide applicator licensing requirements (e.g., Idaho State Department of Agriculture, Oregon Department of Agriculture) when spraying regulated substances, maintaining records per EPA and state standards.
